The Employee must have a valid document authorizing employment before beginning to work. A filing may be expedited to avoid a delayed start date.
An expedited process is necessary to avoid an interruption of employment. The unit may opt to pay the Premium Processing to receive the document before the worker’s current employment authorization expires.
System Regulations 33.99.09, Employment of Foreign Nationals, Section 6.6. provides that each member is responsible for the payment of the premium processing filing fee only in cases in which there is a business need on the part of the member requiring the nonimmigrant petition to be filed under an expedited process.
Expediting a visa process because an employee is traveling for personal reasons (not related to University business) and wants to have the status approved before his/her departure is not a business necessity. In this case, the employee may opt to pay the Premium Processing fee.
