International Visitors

International Visitors are foreign nationals having a residence in a foreign country who are not employees or enrolled students of TAMU-CC and are coming to TAMU-CC on a temporary basis as a result of either a verbal or written invitation made to the foreign national by a faculty member, researcher, or administrator, or who request permission to tour the campus.

For export control purposes, Foreign Nationals are defined as those individuals who are not U.S. citizens, Permanent Residents (“Green Card” holders) or recipients of Political Asylum status.

For individuals, including the categories in 8 U.S.C. 1324b(a)(3), U.S. persons include:

1. US Citizens
2. Lawful permanent residents (i.e., Green Card holders)
3. Other narrow categories including some refugees and asylees.

US government agencies maintain lists of individuals and entities both in the US and abroad who have committee export violations or other offenses. Dealings or export transactions with restricted entities and parties are prohibited without a license from the applicable government agency.

The International Visitor process ensures TAMU-CCs screens and identifies when a license may be required.

Restricted Work Areas should be clearly marked. See 900.03 Template, Signs for Restricted Work Areas for an example. The Responsible Party for the location can answer questions related to the areas restricted.

All international visitors intending to visit TAMU-CC property must undergo a restricted party screening as a condition of their visit to TAMU-CC when the international visitor:

• Will be involved in a research project or collaboration and will have access to laboratories and research facilities for the purposes of observing or conducting research;
• Will be issued a TAMU-CC identification card, keys to offices or laboratories, or otherwise be given access to TAMU-CC’s computing system (subject to further qualification through the visitor host and IT, and otherwise permissible “Guest Wireless” access privileges); or
• Will be paid an honorarium, will be reimbursed for expenses, or will be provided something of value.

Restricted Party Screening is not required of an international visitor if:

• No honorarium or reimbursement of expenses will occur or and
• If one or more of the following conditions exist with respect to the anticipated visit of the international visitor:
  • Meeting with colleagues to discuss a fundamental research project or collaboration;
  • Touring labs or research facilities that are not otherwise subject to a Technology Control Plan (TCP) or,
  • Participating in general academic or scientific meetings or presentations

Denied and Restricted Parties screening requirements are intended to ensure that TAMU-CC does not engage in any activity with a party that is identified as a Restricted Party. All international visitors must undergo restricted party screening when the international visitor:

1. Will be involved in a research project or collaboration and will have access to laboratories and research facilities for the purposes of observing or conducting research;
2. Will be issued a TAMU-CC identification card, keys to offices or laboratories, or otherwise be given access to TAMU-CC’s computing system (subject to further qualification through the visitor host and IT, and otherwise permissible “Guest Wireless” access privileges); or
3. Will be paid an honorarium, will be reimbursed for expenses, or will be provided something of value.

Some areas of our campus have export controlled equipment or data (referred to as Restricted Work Areas). Foreign nationals may not be granted access to export controlled areas during their visit.

Providing Training or Instruction: If you are providing instruction or training, be sure that the information you are sharing is not controlled for export and that providing a service to the country of destination is allowable.

Interaction with Foreign Colleagues: You are free to openly discuss any published or publicly available information or information generated as the result of Fundamental Research, as long as the recipient is not a sanctioned or specially designated entity. It is important to remember that while the results/information resulting from Fundamental Research are not subject to export controls and can be shared without a license, any items, technology, or software generated under that Fundamental Research would be subject to export controls and may require an export license.

The ECO must be immediately notified of any changes in the intent of the visit prior to engaging the international visitor in any activity that may require a Restricted Party Screening or export compliance implementation.
