Dual Intent

In general, a nonimmigrant is someone who intends to remain in the U.S. only for the duration of the proposed activity and does not have an immigrant intent. However, some visa categories, such as the H1B and the O-1, allow nonimmigrants to apply for U.S. permanent residence while holding a nonimmigrant status. This is known as “Dual Intent.”
