Employment Authorization for Certain H-4 Dependent Spouses

In limited circumstances, the H-4 dependent spouses of H-1B nonimmigrants may apply for Employment Authorization using Form I-765, Application for Employment Authorization, if the H-1B nonimmigrant has already started the process of seeking employment-based lawful permanent resident status and, filed a preference petition or Labor Certification one year (365 days) before the expiration of the H1B, whether it is pending or approved; or has been granted H-1B status extension beyond the 6th year cap because s/he holds approved immigrant petition and is eligible for adjustment of status but for the numerical limitations.
