The Employer (the hiring unit) is responsible for paying the legal, processing, and USCIS filing fees for employment-based visas and/or visa extensions.

Foreign national employees are responsible for paying legal and/or filing fees associated with their dependents, including USCIS fees, legal fees, and visa application fees, including reciprocity fees, if applicable.

Most visa processes may be expedited under the USCIS Premium Processing Program; however, the A&M Systems regulations provide the payment of the $2500 fee to expedite a filing only when a business necessity exists.
